A stay of execution of a writ of possession will be granted pending appeal where the appeal is arguable, particularly where the Court of Appeal has previously identified an arguable ground. Where submissions on a review of a single Judge of Appeal's decision differ materially from those made below, the court may take a practical approach under s 56 of the Civil Procedure Act 2005 (NSW) rather than engaging with technical review points.
