A mortgagee's communications with a defaulting mortgagor about the amount required to rectify arrears do not give rise to a promissory estoppel preventing reliance on a default notice where the communications are consistent with a preparedness to withhold action only if the full outstanding arrears are paid. A person claiming a beneficial interest under a resulting trust in mortgaged property held by the registered proprietor is not a necessary party to the mortgagee's possession proceedings, because the effect of any judgment for possession on such a person is only indirect and consequential.
