The complexity of statutory interpretation issues in building payment disputes does not make rejection of a genuine Calderbank offer reasonable; rather, such complexity makes settlement all the more desirable. However, a Calderbank offer made at trial that is not renewed on appeal will not support an order for indemnity costs on appeal, particularly where the offeree was successful at first instance.
