Rejection of an offer of compromise is not unreasonable where the offeree ultimately recovers more than the amount offered, even substantially more. A cross-claim that is permitted to proceed on appeal and is subsequently upheld at trial cannot be characterised as having no real prospects of success for the purpose of indemnity costs.
