An ordinary homeowner is not required to remove or illuminate all potential obstacles on a residential lawn at nightfall. Objects commonly found on suburban lawns (hoses, gardening tools, children's toys, wire mesh) do not ordinarily give rise to a breach of the duty of care under s 5B(1)(c) of the Civil Liability Act 2002 (NSW), even where a visitor is injured at night. The probability of harm from such objects on private property, away from the ordinary path of access, is fairly low, and the standard of care must be assessed having regard to the ordinary practices of reasonable householders.
