Where a sentencing judge finds special circumstances under s 44 of the Crimes (Sentencing Procedure) Act 1999 (NSW), the benefit of that finding must be reflected in the aggregate non-parole period, not merely in individual sentences that are then substantially accumulated. Where psychiatric illness is causally related to offending and is amenable to treatment, it is an error to emphasise specific deterrence; the treatability of the condition reduces the need for specific deterrence. Sentencing in round figures is preferred over years, months and days when applying percentage discounts for guilty pleas.
