Section 50DB of the Crimes Act 1914 (Cth) imposes direct liability for encouraging sexual intercourse with a child under 16 outside Australia; the person encouraged need not be an Australian citizen or resident. Where multiple offences under s 50DB involve overlapping elements of criminality, identical concurrent sentences will constitute error under the Pearce principle and sentences must be individually calibrated with appropriate accumulation. No allowance in sentencing should be made for extra-curial punishment common to all custodial sentences, and it is not generally appropriate that wealthy or well-known offenders receive lesser sentences because they have more to lose.
