Significant activities with respect to two or more cars in contravention of s 154G of the Crimes Act 1900 (NSW) will, in the absence of significant mitigating circumstances, give rise to a full-time custodial sentence rather than an intensive correction order. A suitability assessment report under s 69 of the Crimes (Sentencing Procedure) Act 1999 (NSW) is a necessary pre-condition to making an intensive correction order. Evidence of an offender's experience of a sentence prior to appeal is generally not admissible to demonstrate the sentence is not unduly lenient, but may be taken into account upon resentencing.
