Serious fraud by company directors involving substantial sums and breach of trust requires full-time custodial sentences, and intensive correction orders are inappropriate for such offences. Psychiatric evidence based on untested histories provided by an offender who does not give evidence at the sentencing hearing is of limited weight, particularly where the offender bears the onus of establishing a causal connection between mental condition and offending. The Crown's contribution to a sentencing judge's factual error does not necessarily warrant exercise of the residual discretion to dismiss a Crown appeal where the interests of justice require resentencing.
