A sentencing court exercising the s 10 discretion may take into account the prospect that a conviction could have detrimental consequences for employment, but generalised prognostications about overseas travel restrictions unsupported by clear evidence are not proper matters for consideration under s 10(3)(d). The imposition of a conditional bond without recording a conviction is not automatically or necessarily coextensive with an inadequate sentence; where the Crown's own position is that a s 9 bond is appropriate, the only difference being the recording of a conviction, the s 10 bond may adequately serve all sentencing purposes.
