A fixed term of imprisonment cannot be imposed for an offence carrying a standard non-parole period under s 45(1) of the Crimes (Sentencing Procedure) Act 1999 (NSW). Where such an error occurs, the appropriate course is to remit the matter to the sentencing judge for re-sentencing rather than for the appellate court to re-sentence.
