A person who carries a loaded pistol whilst engaged in the supply of drugs may be treated as a serious and significant participant in the drug supply enterprise, and not a lesser or minor player — this factor is relevant to the objective seriousness of the drug supply offence. Fixed term sentences imposed for standard non-parole period offences in breach of s 45(1) Crimes (Sentencing Procedure) Act 1999 are not invalid but may be corrected by the sentencing court under s 43. The CCA cannot correct such errors absent a ground of appeal or the application of s 6(3) or s 7(1A) Criminal Appeal Act 1912.
