'Violence' in the definition of 'serious sexual offence' under the Dangerous Prisoners (Sexual Offenders) Act 2003 (Qld) requires force significantly greater than mere physical contact. It does not encompass any assault within s 245 of the Criminal Code. The violence contemplated normally involves force to facilitate rape under s 349 of the Criminal Code, or force causing or likely to cause significant physical injury or significant psychological harm. Indecent assaults involving touching, grabbing or groping without more do not constitute offences 'involving violence' for the purposes of the Act.
