Section 13(1) of the Penalties and Sentences Act 1992 (Qld) does not require a mandatory one-third discount on the head sentence for a guilty plea; the extent of any reduction, if given, is a matter for the sentencing discretion. Where prior convictions are not alleged by notice as a circumstance of aggravation, the sentencing court remains entitled to have regard to those convictions in determining sentence; the failure to allege them only affects the applicable maximum penalty.
