The word 'drainage' in a registered easement for 'drainage and stormwater' includes the drainage of sewage in its ordinary meaning. When construing registered easements under the Torrens system, evidence of the intentions and contemplations of the parties is inadmissible, but an important consideration in determining whether extrinsic information can be used is whether it was and remains publicly available to third parties without unreasonable effort, expense or delay. Physical characteristics of the tenements remain admissible. Documents from council development application files and town planners' files that are not publicly available and not referenced in the register must be disregarded.
