Regulation 5 of the Controlled Substances (General) Regulations 2000 (SA) does not create separate controlled drugs for each form (salt, derivative, isomer, analogue, homologue) of a substance listed in Schedule 1; rather, it broadens the scope of Schedule 1 so that each form is treated as the same controlled drug. The 'Commercial (pure)' quantity listed in Schedule 1 applies to the weight of the pure controlled drug within any preparation, admixture or solution, including salt form. This resolves the uncertainty created by R v Willingham [2011] SADC 172.
