A trial judge's erroneous belief that ss 34CB and 34M of the Evidence Act 1929 (SA) applied does not necessarily result in misdirection if the directions actually given satisfy the applicable common law requirements for Longman warnings and Kilby directions. A finding of reasonable possibility of concoction between multiple complainants does not automatically require acquittal on all counts — the jury may still convict on individual counts proved beyond reasonable doubt on the evidence of a single complainant whose account is accepted. Credibility assessments on voir dire are permissible when determining whether a reasonable possibility of concoction exists, provided the judge does not make a preliminary finding on the ultimate issue of whether concoction occurred.
