An applicant for compensation under s 86 of the Sentencing Act 1991 (Vic) cannot delay making an application on the basis that the offender is believed to be impecunious; the section does not contemplate waiting until the offender is in a position to satisfy a compensation order. The phrase 'as soon as practicable' is a limitation provision requiring the application to be made within a matter of weeks of conviction. Separately, a body subrogated to the rights of beneficiaries under s 217 of the Legal Practice Act 1996 is entitled to the benefit of s 21(1)(a) of the Limitation of Actions Act 1958, which removes any limitation period for fraudulent breach of trust.
