The requirement for damages to be an inadequate remedy may not be a separate element of the test for interlocutory injunctions in Western Australia, but rather one of the matters to be addressed in the court's consideration of the balance of convenience and justice, following the Full Federal Court's reconciliation in Samsung Electronics Co Ltd v Apple Inc. Challenges to the jurisdiction of the Supreme Court of Western Australia based on the nature of the seal affixed to court documents are hopeless. A mortgagee in possession who has been dispossessed by threats of violence has a strong basis for obtaining mandatory interlocutory injunctions restoring possession.
