This is the first appellate decision on sentencing for offences under ss 77 and 80B of the Criminal Code (WA). Personal and general deterrence are the primary sentencing objectives for racial vilification offences, with personal circumstances of the offender accorded less weight. A self-represented accused who deliberately adopts a defiant and uncooperative stance cannot later complain of procedural unfairness where the trial judge gave appropriate opportunities to participate. The Re F; Litigants in Person Guidelines from the Family Court do not apply to criminal trials.
