The principles governing suspension orders under s 15 of the Civil Judgments Enforcement Act 2004 (WA) are not materially different from those which applied to stay of execution applications before the Act. An applicant must demonstrate special circumstances justifying departure from the ordinary rule that a successful party is entitled to enforce judgment pending appeal, including that the suspension is reasonably necessary to preserve the subject matter or integrity of the litigation, or that refusal could create practical difficulties in respect of relief on appeal. A mere desire to avoid payment pending exhaustion of all appeals is insufficient.
