The obligation of a legal practitioner to perform an undertaking is a solemn obligation of the utmost importance; breach of a clear and unambiguous undertaking involving substantial funds, with reckless disregard and without reasonable justification, warrants a significant fine rather than merely a reprimand. A costs order consequent upon a practitioner's stance in disciplinary proceedings is not a component of penalty. A supervised practice condition that bears no relationship to the misconduct and imposes no real restriction serves no useful purpose as a penalty.
