Notification of the issue of a telecommunications service warrant under s 47(a) of the Telecommunications (Interception and Access) Act 1979 (Cth) requires only compliance with s 60(1)(c) (informing the carrier forthwith), not s 60(1)(d) (providing a certified copy as soon as practicable). Failure to serve a certified copy within time does not render intercepted communications inadmissible under s 74. Even if it did, such failure constitutes a non-substantial irregularity under s 75 that may be disregarded. The Tanevski decisions of the District Court should not be followed on these points.
