A s 46(4) review of a single judge's refusal to extend time for filing a notice of appeal will not succeed absent demonstrated error of law, material error of fact, or failure to consider material matters. Lack of legal knowledge by self-represented litigants is a misfortune, not a privilege, and cannot excuse gross delay in filing an appeal. Where proposed grounds of appeal have very weak prospects of success, an extension of time will be refused even where the applicant is self-represented and residing overseas.
