The manipulation of hydraulic lifting mechanisms on a stationary front end loader constitutes 'operation' but not 'driving' of the vehicle for the purposes of s 3A(1)(a) of the Motor Accidents Compensation Act 1999 (NSW), even where the steering wheel is turned to achieve lateral movement of the tines while the vehicle remains stationary. An object suspended from a vehicle by a chain (such as a chute) is not part of the vehicle for the purposes of s 3A(1)(b) collision provisions. A dangerous situation created by an instruction to a worker to place himself in a position of danger is not a dangerous situation 'caused by the driving of the vehicle' under s 3A(1)(d), even where the vehicle was driven to the location earlier.
