Where an appeal court reverses a partition order and substitutes an order for sale of co-owned land, the analogy with dissolution of partnership should be maintained in full, with costs of both parties at first instance paid from the proceeds of sale. A successful appellant in such proceedings is not entitled to a simple reversal of the costs order below where the original order reflected the appellant's own unreasonable conduct.
