Where multiple respondents are separately represented but have identical interests on a discrete question on appeal, the court will limit the unsuccessful party to paying only one set of costs. Advance notice of objection to more than one set of costs under UCPR r 51.4(5) may be given in the summary of argument and need not await the filing of respondents' submissions. A respondent who takes an ambivalent stance on a costs variation motion but files submissions disputing the applicant's propositions will not escape liability for costs of the motion.
