Non-compliance with successive court orders for filing submissions, where an explanation is proffered and the delay occurs over a court vacation period, does not without more constitute contumelious or plainly unreasonable conduct warranting indemnity costs. A costs assessor may, however, take into account the consequences of late compliance (such as the need to brief replacement counsel) in assessing party and party costs.
