A tutor who presses unmeritorious proceedings on behalf of a person under legal incapacity, particularly after being offered the opportunity to discontinue with no costs consequences, will be personally liable for costs. Ignorance of the right to appeal and ongoing settlement negotiations do not justify delay in filing appellate process.
