Where both parties rely exclusively on affidavit evidence and neither is cross-examined, a trial judge may not make adverse credibility findings against a party based on their courtroom presentation, particularly where the party is unrepresented and not on oath. Where such flawed credibility findings are the basis for preferring one party's evidence, the appellate court is in as good a position as the trial judge to assess the evidence and determine a just and equitable outcome. A first home owner's grant used as a party's contribution to the purchase price and reflected in their registered interest cannot be double-counted as an additional cash contribution.
