The Briginshaw standard applies to findings of serious crime related activity under s 27 of the Criminal Assets Recovery Act 1990 (NSW), and the gravity of CAR Act proceedings (as a drastic interference with property rights) is a relevant consideration under s 140(2) of the Evidence Act 1995. However, circumstantial evidence and credibility findings by a trial judge, assessed against the totality of the evidence, can satisfy this standard. The Jones v Dunkel rule does not permit speculation about what an uncalled witness might have said, nor does it permit a positively adverse inference against the party who failed to call the witness.
