Claims for damages for nervous shock or psychiatric illness arising from the death of a person from a dust-related disease do not fall within the exclusive jurisdiction of the Dust Diseases Tribunal under s 11(1) of the Dust Diseases Tribunal Act 1989. Such claims must be brought in the Supreme Court or District Court, unless they are included in existing Tribunal proceedings via the ancillary or related jurisdiction under s 11(4). Claimants pursuing nervous shock claims via s 11(4) will not have the benefit of substantive provisions such as s 11A (provisional damages), s 12A (removal of limitation periods), or s 12B (non-economic loss for estates).
