Clause 26 of Schedule 6, Part 19H of the Workers Compensation Act 1987 (NSW) does not preserve the operation of repealed s 151P(b) for non-worker relatives of injured coal miners. The phrase 'to or in respect of an injury received by a coal miner' is confined to the coal miner and the coal miner's dependants (via the extended definition of 'worker' in s 3(1A)), and does not extend to strangers to the employment relationship who suffer nervous shock. Accordingly, s 151AD precludes nervous shock claims by non-worker relatives against the employer of an injured coal miner. The same analysis would apply to the equivalent provision for police officers, paramedics and firefighters in cl 25.
