The definition of relevance under SCR Pt 23 r 1(d) requires documents to rationally affect the assessment of the probability of the existence of a fact in issue, and this assessment must take account of inferences which might be drawn from documents when considered in the light of other evidence, rather than as viewed in isolation. A reference to documents 'capable of informing' the issues does not adopt the discarded 'train of inquiry' test. In negligence cases involving corporate defendants, documents need not relate specifically to the individual plaintiff to be relevant; documents concerning foreseeable risk to the class of persons of whom the plaintiff was one are encompassed within relevant documents.
