An explanation for delay in seeking leave to amend that amounts to no more than inadvertence by legal advisers may be given no weight as a factor in favour of leave, without that constituting error in the exercise of discretion. The importance of a proposed amendment, even where described as 'critical', does not override other factors including gross delay and likely vacation of a hearing date in the balancing exercise required by Aon.
