The phrase 'claim for compensation' in Schedule 6, Part 19H, clause 15 of the Workers Compensation Act 1987 (NSW) means a claim for compensation generally, not a claim specifically for lump sum compensation. A worker who made any claim for compensation before 19 June 2012 in respect of the relevant injury is not subject to the 2012 amendments restricting lump sum compensation to injuries causing greater than 10% whole person impairment. Clause 11 of the Workers Compensation Amendment (Transitional) Regulation 2012, which purported to narrow this protection, is beyond power. The regulation-making power in Schedule 6 does not permit regulations that prejudicially affect rights accrued before the date of publication.
