A finding of Muldrock error in the sentencing judge's approach to the standard non-parole period does not automatically warrant an extension of time or a lesser sentence. Where the offence involves a home invasion committed in company with significant violence and the applicant was the orchestrator, the sentence may be upheld notwithstanding the error. The subjective circumstances of the offender, including youth, limited criminal history, and PTSD from witnessing a partner's murder, were insufficient to displace the appropriateness of the sentence.
