Where Muldrock error is established and the CCA re-exercises the sentencing discretion, the Court must independently determine the appropriate sentence. If the Court concludes a greater sentence is warranted but no Parker warning was given, the appeal will be dismissed. The Court is not always required to specify the precise sentence it would have imposed; it may be sufficient to demonstrate the re-sentencing exercise was carried out and explain why a greater sentence was warranted.
