On an application for a substantial extension of time to appeal against conviction, the applicant must make out a proper case for the extension having regard to the delay, the explanation for the delay, the interests of the community and the victim, and the strength of the proposed appeal grounds. Where the applicant's primary evidence in support of the proposed grounds is rejected, and what remains is an incompletely explained failure to call character evidence against a very strong Crown case, the proposed grounds may be insufficiently arguable to warrant the extension.
