The principle that extra-curial punishment does not extend to self-injury deliberately inflicted during the commission of a crime (Christodoulou) was affirmed. A sentencing history of comparable cases does not fix the boundaries within which future judges must sentence; comparable cases are illuminating but no more than historical statements of what has happened in the past. An unrepresented applicant suffering from major depressive illness and psychotic episodes in custody may be granted an extension of time to appeal against sentence, even where the delay is almost three years.
