A compromise agreement that requires a party to re-litigate an issue already determined by a court is void as contrary to the public policy interest in the finality and authority of court orders. A party who elects not to appeal a costs order cannot circumvent that order by entering into a private agreement that effectively requires the other party to re-litigate the costs question.
