An offer to settle under ch 9 pt 5 UCPR does not of itself justify indemnity costs on appeal, but a combination of circumstances including rejection of a reasonable settlement offer, lack of real prospects of success, attempt to circumvent a prior court order, and the small amount at stake may together warrant indemnity costs. Non-compliance with Practice Direction requirements for costs applications does not necessarily disentitle a party from seeking such an order.
