Under the Criminal Code (Qld), where an accused does the positive act that causes death with the requisite intention, the offence is murder under s 302 regardless of the deceased's desire to die or procurement of the accused's assistance. Section 311 (aiding suicide) applies only where the deceased brings about their own death by their own act and another person assists but does not do the deed. The concept of causation in homicide does not extend to treating the deceased's moral or persuasive influence as a 'cause' of death capable of breaking the chain of causation.
