Where a prosecutor relies on inconsistencies between an accused's police interview and trial evidence to assert fabrication and guilt, the trial judge must require the prosecutor to identify specific lies capable of indicating consciousness of guilt and, if satisfied they are so capable, must give an Edwards direction. Failure to do so creates a very real risk that the jury will treat the accused's evidence at large as demonstrating guilt without proper consideration, resulting in a miscarriage of justice. The failure to give the mandatory s 21AW(2) direction regarding support persons for child witnesses giving pre-recorded evidence is an error that may cause a substantial miscarriage of justice.
