Where jurisdictional error in an adjudication decision under the Building and Construction Industry Payments Act 2004 (Qld) affects an identifiable and relatively small component of the adjudicated amount and does not taint the whole decision-making process, the Court may decline to declare the decision void on condition that the claimant repay the affected amount with interest and GST, rather than voiding the entire decision. The appropriate rate of interest on such repayment is the commercial rate supported by evidence, not the default judgment rate.
