A party raising proportionate liability under Part IVAA of the Wrongs Act 1958 (Vic) must plead the material facts engaging the statute and must ensure that alleged concurrent wrongdoers remain parties to the proceeding or seek leave for joinder under s 24AL. A defendant cannot seek statutory contribution from a plaintiff under s 23B; contribution is only recoverable from another person liable to the plaintiff for the same damage.
