The Court of Appeal dismissed the appeal for the appellant's failure to file an appellant's case pursuant to r 43(2)(g)(ii). In addition, the Court noted that the foreshadowed grounds of appeal had already been found to have no reasonable prospect of success by Newnes JA in earlier interlocutory proceedings, and an application to review that decision had also been dismissed.
