An applicant seeking review of a single judge's decision under r 8(1) of the Supreme Court (Court of Appeal) Rules 2005 (WA) must demonstrate error in the decision. A stay of proceedings pending appeal will not be granted where the appeal has no prospect of success. Contentions that registrars and judges are not validly constituted remain devoid of legal merit and do not give rise to constitutional issues requiring notification under s 78B of the Judiciary Act 1903 (Cth).
