A stay of proceedings pending an application for leave to appeal from an interlocutory decision on a matter of practice and procedure requires the applicant to demonstrate at least a clear case of material error or an outcome so adverse that justice necessitates interlocutory intervention. A stay application is not competent absent the filing of originating process seeking leave to appeal. An application for a stay should first be made in the court below, not directly to the Court of Appeal.
