A court will not vacate a hearing date at a late stage because a party's support person has become unavailable, particularly where the unavailability was known for some time. Applications for pro bono referral under UCPR r 7.36 may be refused where the case turns largely on factual issues well understood by the applicant and the application is made at a late stage.
